These Terms of Service ("Terms") govern your access to and use of Fineduca's stock analysis platform, including our website, applications, and services (collectively, the "Service"). These Terms constitute a legally binding agreement between you and Fineduca.

2. Eligibility

• You must be at least 18 years old to use the Service
• If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization
• You must provide accurate and complete information during registration
• You must not be prohibited from using the Service under applicable law

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Subscription Plans and Payments

4.1 Free and Paid Plans

• Free Plan: Limited features with daily usage limits
• Pro Plan: Unlimited access to all features (€19.99/month)

4.2 Billing and Payments

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• Prices are subject to change with 30 days' notice
• All fees are non-refundable except as required by law (EU Consumer Rights)
• You authorize recurring charges to your payment method

4.3 Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• You retain access until the end of the paid period
• EU 14-Day Right of Withdrawal: EU consumers may cancel within 14 days of purchase for a full refund (if service not fully used)

5. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction (including securities regulations)
• Scrape, harvest, or collect data from the Service using automated means
• Reverse engineer, decompile, or disassemble any part of the Service
• Circumvent usage limits or access controls
• Share your account with others or create multiple accounts
• Impersonate others or provide false information
• Transmit viruses, malware, or harmful code
• Overload or interfere with the Service's infrastructure
• Use the Service to manipulate securities markets

• Stock data is provided "as is" from third-party sources (Polygon.io, Cloudflare Workers)
• We do not guarantee accuracy, completeness, or timeliness of data
• Data may contain errors, delays, or omissions
• AI-generated insights are algorithmic suggestions, not professional analysis
• You should independently verify all information before making decisions

8. Intellectual Property

8.1 Our Intellectual Property

All content, features, and functionality of the Service (including software, design, text, graphics, logos) are owned by Fineduca and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of any data you input (watchlists, portfolios, notes). By using the Service, you grant us a license to use this data to provide and improve the Service.

8.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE"
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We do not warrant the accuracy or reliability of any information on the Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Fineduca shall not be liable for any indirect, incidental, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
• We are not liable for investment losses or decisions made based on our Service
• EU Consumer Rights: Nothing in these Terms limits liability that cannot be excluded under EU law (e.g., death, personal injury, fraud)

11. Indemnification

You agree to indemnify and hold harmless Fineduca from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your investment decisions based on the Service

12. Third-Party Services

The Service integrates with third-party services (Stripe, OpenAI, Polygon.io). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

13. Privacy and Data Protection

14. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.

15. Termination

15.1 By You

You may terminate your account at any time from account settings. Paid subscriptions continue until the end of the billing period.

15.2 By Us

We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or for any reason with notice.

15.3 Effect of Termination

Upon termination, your right to use the Service ceases. We may delete your data after 30 days (see Privacy Policy). Provisions that should survive termination (indemnification, disclaimers, limitations) remain in effect.

16.1 Governing Law

• Severability: If any provision is invalid, the remaining provisions remain in effect
• No Waiver: Failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms. We may assign them without notice
• Force Majeure: We are not liable for delays or failures due to events beyond our control
